Wigdor LLP Defeats Three Motions to Dismiss in Sara Ziff v. Fabrizio Lombardo et al

On November 26, 2024, the Supreme Court of the State of New York denied Fabrizio Lombardo, Harvey Weinstein, The Walt Disney Company, and Miramax Film’s motions to dismiss the action against them.


Wigdor LLP commenced action on behalf of Ms. Ziff in April 2023, pursuant to New York’s Adult Survivors Act, alleging that defendant Fabrizio Lombardo sexually assaulted her in 2001, at the age of 19 while working as a model and aspiring actor. Fabrizio Lombardo, Harvey Weinstein, The Walt Disney Company, and Miramax Film each moved to dismiss the respective causes of action asserted.


In a joint statement, plaintiff attorneys Meredith A. Firetog (Wigdor LLP) and Kevin Mintzer (Kevin Mintzer, P.C.) say “Ms. Ziff has endured immense trauma at the hands of Mr. Lombardo, who was one of Harvey Weinstein’s key enablers. Disney and Miramax should have prevented Mr. Lombardo from raping Ms. Ziff, who was then just 19-years-old, but they instead let him and Mr. Weinstein run amok. We look forward to the case proceeding to discovery and holding all of the defendants accountable for the harm inflicted on Ms. Ziff.”
